This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services. Pollywoggles (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information I gather, how I use it, what I do to protect it, and to assist you in making informed decisions when using our Service. 
 
For purposes of this Agreement, “Service” refers to the Company’s service which can be accessed via our website at www.pollywoggles.ca or through a mobile application. The terms “I,” “me,” and “my” refer to the Company. “You” refers to you, as a user of Service.

 

Service is hosted by BigCommerce. (“BigCommerce”).  BigCommerce provides me with the online e-commerce platform that allows me to provide the Service to you.  Your information, including Personal Information, may be stored through BigCommerce’s servers.  By using the Service, you consent to BigCommerce’s collection, disclosure, storage, and use of your Personal Information in accordance with BigCommerce’s privacy policy available at https://www.bigcommerce.com/privacy.  

 

Consent
By accessing and/or using my Service, you accept this Privacy Policy and Terms of Use, and you consent to the collection, storage, use and disclosure of your personal information as described in this Privacy Policy. Each time you visit the website, or use the Service, and any time you voluntarily provide us with information, you agree that you are consenting to my collection, use and disclosure of the information that you provide, and you are consenting to receive emails or otherwise be contacted as described in this Privacy Policy.

 

Information I Collect

Information that is collected may be “Non-Personal Information” and “Personal Information” about you. “Non-Personal Information” includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks, the type of browser you use, the device which you connected to the Service, time and date of access, etc.  This information is tracked using cookies, or small text files which include an anonymous unique identifier.  Cookies are sent to a user's browser from the server and are stored on the user's computer hard drive.  Sending a cookie to a user's browser enables the collection of Non-Personal Information.  Cookies may be "persistent" or "session"  Persistent cookies remain on your computer until you delete them, while session cookies expire when you close your browser.  


“Personal Information” includes information that can be used to personally identify you, such as your name, address and email address.  To fulfill your order, you must provide me with certain information, such as your name, email address, postal address, payment information, and the details of the item that you are ordering. You may also choose to provide me with additional personal information if you contact me directly.

 

Why I Need Your Information and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including:
~ as needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support;
~ when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
~ if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
~ as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as with providing and improving my services. I use your information to provide the services you requested (ie. delivery of a digital product), and in my legitimate interest to improve my services (such as, to contact you with an update to a pattern you have already purchased).

 

Information Sharing and Disclosure
In general, your Personal Information will not be shared with a third party without your consent.  Information that is shared with a third-party provider who is performing services for the Company, and only for the specific necessary purpose.  For example, when you provide Personal Information to complete a transaction, your credit card will need to be verified.  These third-party service providers, such as a payment processor, also have their own privacy policies.  It is recommended that you read their privacy policies for more information on how they handle your Personal Information.  Otherwise, sharing your personal information may occur only under extremely limited circumstances, such as (a) to respond to legal process or to government requests; (b) to enforce my agreements, terms and policies; (c) to prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) to protect the rights, property, and safety of my customers, or others.

 

Data Retention
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 7 years.

I implement reasonable precautions and follow industry best practices in order to protect your Personal Information and ensure that such Personal Information is not accessed, disclosed, altered or destroyed.  However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such precautions. By using our Service, you acknowledge that you understand and agree to assume these risks.

 

Transfers of Personal Information Outside the EU
I may store and process your information offline or in hardcopy for record keeping and tax purposes.  This information is stored on a secure private harddrive and will not be transferred or stored in an online or cloud-based format for any reason.

 

Your Rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
~ Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
~ Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Except in cases where I am legally required to store data, I will delete your personal information upon request.  Promotional emails will only be sent to those who sign up for my email newsletter; no Personal Information gathered through ordering products will be used for any marketing purposes.  Please note that we may continue to send you administrative emails, such as updates to our Privacy Policy or updates to previously purchased patterns (not a promotion), unless you request to be removed from these mailings.
~ Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
~ Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

 

Age of Consent
 By using the Service, you represent that you are at least 18 years of age. 
 
Changes to Privacy Policy
 The Company reserves the right to change this Privacy Policy and our Terms of Use at any time. If a change is made, it will be posted on this page so that you are always aware of what information I collect, how I use it, and under what circumstances I disclose it. Any such modifications become effective upon your continued access to and/or use of the Service five (5) days after we first post the changes on the website or otherwise provide you with notice of such modifications. It is your sole responsibility to check this website from time to time to view any such changes to the terms of this Privacy Policy. If you do not agree to any changes, if and when such changes may be made to this Privacy Policy, you must cease access to this website. If you have provided your email address to us, you give us permission to email you for the purpose of notification as described in this Privacy Policy.
